Cancellation and return conditions
The guest has the right to withdraw from the contract in writing at any time.
Cancellation up to 30 days before the start of the program will not incur any costs.
The following cost regulations apply in the event of a cancellation at a later date:
- 30th to 14th day before tour start: 50% of the total amount
- 14th to 7th day before tour start: 75% of the total amount
- Up to 7 days before the start of the tour: 100% of the total amount
In addition, the participant is responsible for any cancellation costs of hotels, huts, etc.
We therefore recommend that you take out travel cancellation insurance.

If the place made available by the withdrawal can be resold, no costs will be incurred.
Changes of dates apply in the same way as cancelations and new bookings.
If a guest fails to arrive at the agreed starting point of the tour or if the departure for the tour is missed due to negligence on the part of the guest or force majeure, 75% of the tour fee plus any expenses may be retained by the mountain school.

- Scope of application, service content:
Hinterstein | Bergschule Lechtal provides its services exclusively on the basis of the following General Terms and Conditions (GTC). These apply to all legal relationships between the mountain school and the guests, even if they are not expressly referred to.the mountain guide contract includes all obligations as a mountain guide to lead a guest on a specific tour. In return, the guest undertakes to pay the fee, unless it has been expressly agreed that the service is free of charge, and the participant must meet the requirements stated in the programs or tour descriptions. Each guest is responsible for the condition and maintenance of any equipment they bring with them and for their own state of health. In order to assess the suitability of the individual guest for the planned tour, the guest undertakes to provide truthful information to the mountain school and, due to the legal obligation, the mountain guide must ensure that the guests are adequately equipped and meet the requirements before starting a tour. The mountain guide reserves the right to refuse to guide persons who are inadequately equipped or obviously unable to cope with the difficulties of the planned undertaking. Despite the best tour planning and guidance, no unrestricted guarantee of success can be given for reaching the planned program objectives or the summit. Decisions regarding the choice between several route variants, regarding the continuation and termination of the tour, regarding the inclusion of breaks and their lengths, the decision regarding the carrying and use of equipment (especially ropes, crampons, crampons, ice axes, etc.) are the sole responsibility of the mountain guide.no claims for compensation can be made for tours that are not carried out for safety reasons (such as falling rocks and ice, avalanches, falls, weather changes, etc.) or through the fault of the participant.Damage resulting from loss or repair costs for damage to the rental equipment that goes beyond normal wear and tear must be compensated by the participant. Due to the special responsibility for the correct execution of the tour, the guests undertake, by concluding the mountain guide contract, to submit to the instructions of the mountain guide, which he gives in his function as the responsible and expert leader of the tour. Should these instructions be ignored by the guests, the mountain guide cannot be held responsible for any resulting consequences.
- Conclusion of contract:
The mountain guide contract between the guest and the mountain school is concluded when there is agreement on the essential elements of the contract (aim/purpose of the undertaking, fee, time and number of people to be guided, etc.). Bookings can be made in writing or verbally. Telephone bookings are legally binding. If several participants book at the same time, the person who makes the booking shall be liable for payment of the invoice amount. It is assumed that they are acting in their own name. Furthermore, if a mountain guide contract is concluded for the leading of a mountain tour with several people, all guests are jointly and severally liable for the fee claim.the mountain guide reserves the right to change, restrict or extend the training and tour program at any time due to unforeseeable circumstances. Due to the dependence on weather conditions or other unforeseeable circumstances, the originally planned tour itinerary cannot always be guaranteed. 100% of the invoice amount will be charged immediately after registration, as we have a large number of bookings as a mountain school. Advance payments and partial payments are only possible in exceptional cases and only with the express consent of the mountain school. For bookings made at short notice (up to 2 days before the start of the tour or training course) and for bookings made on the premises of the mountain school, cash payment on site can also be agreed.costs not listed in the services, in particular costs for accommodation (overnight stay, food, drink), costs for rental equipment, are – unless otherwise agreed or stated separately – to be borne by the participant.
- Change in the person of the guest:
If the guest is prevented from taking part in the tour, he/she may transfer the contractual relationship to another person, provided that this person fulfills all the conditions for participation and the transfer is notified to the mountain school within a reasonable period before the departure date. The transferor and the transferee are jointly and severally liable for any unpaid fees and any additional costs incurred as a result of the transfer. A refusal of the transfer by the Mountain School is possible for objectively justified reasons.
- Minimum number of participants:
All events can only be held if the specified minimum number of participants is reached. If this is not the case, the Bergschule is entitled to withdraw from the contract up to 7 days before the start of the event. The fee already paid will be refunded in full. If the guest nevertheless insists on the event taking place, a new offer with a recalculated price can be submitted. If the guest agrees to the recalculated price, a new contract is concluded. However, there is no obligation on the part of the Bergschule to hold the event again.
- Insurance:
Bergschule Lechtal | Hubertus Johannes Lindner has the legally required liability insurance. Any private insurance (e.g. accident insurance) in connection with the planned tours must be taken out by the guests themselves. It should be noted in this context that helicopter or mountain rescue operations can incur very high costs, which are generally not covered by the relevant social insurance institutions and must therefore be paid by the guest concerned. It is therefore strongly recommended that you take out mountain rescue insurance. The price/performance of the mountain cost insurance, including other benefits, is optimal if you are a member of the Alpine Club! There is no cancellation insurance. Guests are responsible for complying with any passport, visa, customs, foreign exchange and health regulations at their own expense.
- Warranty:
The guest has a warranty claim in the event of non-performance or defective performance. The guest agrees that a defect-free service will be provided within a reasonable period of time instead of his claim for redhibitory action or price reduction, insofar as this is possible. In any case, the guest is obliged to notify the mountain guide of any improvements made during the current mountain tour; if a service disruption is attributable to the guest, such as a health impairment (e.g. too slow acclimatization to the altitude, lack of fitness, etc.), the guest cannot derive any claims from this.
- Compensation for damages:
In the event of a culpable breach of an obligation arising from the contractual relationship, the Mountain School is liable to the guests for compensation for the resulting damage within the scope of the legally required liability insurance for personal injury, property damage and financial loss, provided that all other legal requirements are met. Claims for compensation for loss of vacation enjoyment are also excluded. Any compensation for damages is limited to the amount of liability insurance cover in force at the time.Apart from the statutory liability situations, guests take part in the mountain tours at their own risk. A considerable degree of prudence and independence is required even for beginners. The mountain school cannot accept any responsibility for accidents, damage or other irregularities resulting from the realization of alpine dangers (e.g. danger of falling, altitude sickness, cold damage, avalanche danger, crevasse fall, rockfall). All events are prepared and conducted to the best of our knowledge and belief. No guarantee can be given for summit successes or the fulfillment of subjectively imagined destinations. It is in the nature of the event that a certain residual risk and uncertainty remains for the guest. Appropriate tour preparation through endurance sports, appropriate technical training and personal prudence reduces the risk of accidents and is therefore strongly recommended to every guest.
- Withdrawal from the contract:
The guest has the right to withdraw from the contract in writing at any time. Cancellations up to 30 days before the start of the program will not incur any costs. Cancellation at a later date will incur the following costs:
- up to 14 days before tour start 50%
- until 7th day before tour start 75%
- up to 7 days before the start of the tour 100% of the respective feeIn addition, any cancellation costs of hotels or huts etc. are to be borne by the participant. - Withdrawal of the mountain guide prior to departure:
If the mountain school has to withdraw from the contract due to unusual and unforeseeable events over which it had no influence and the consequences of which could not have been avoided despite exercising due care, the guest must reimburse the expenses incurred to date. Such events include, for example, government orders, strikes, war or war-like conditions, natural disasters, epidemics, weather and avalanche conditions, etc.. The part of the management fee exceeding the reimbursement of expenses shall be reimbursed.
- Cancellation by the mountain school after the start of the trip:
The Mountain School shall be released from its obligation to provide services if a guest disrupts the tour in the long term or endangers others through improper and grossly careless behavior during a tour – regardless of a warning.
In this case, the guest is liable to pay compensation to the mountain school if he/she is at fault.
In such a case, the guide fee will not be refunded.
- Changes to the contract:
The Mountain School reserves the right to increase the fee confirmed with the booking for reasons beyond the control of the Mountain School if the date is more than three months after the conclusion of the contract. Such reasons include, for example, changes in any transportation and climbing costs or the exchange rates applicable to the tour.
All tours are subject to program changes due to changes in the weather, other alpine dangers, the physical condition of individual guests and other factors. According to the applicable mountain and ski guide law, the mountain guide is obliged to cancel a mountain tour if unforeseeable special circumstances arise in which the physical safety of his guests appears to be at risk. The guests can therefore not assert any claims for compensation against the mountain school due to these circumstances. In this case, the decision must be based on the weakest guest and the other guests on the tour share the same fate.
- Provision of information to third parties:
Information about the names of guests and their places of residence will not be provided to third parties, even in urgent cases, unless the guests have expressly requested such information. The costs arising from the transmission of urgent messages shall be borne by the traveler.
- Data protection and advertising:
The Mountain School is entitled to process and store personal data in the context of contract processing and for purposes arising from the contract. Furthermore, when booking, the guest expressly agrees to pass on personal data to course instructors, participants and accommodation. By participating in an event, the participant agrees that videos and photos taken of him/her during the activity may be used for advertising purposes by the mountain guide/mountain school.
- Vouchers:
vouchers are valid for 2 years from the date of issue.
vouchers cannot be redeemed in cash.
- Final provisions:
Austrian law shall apply to the exclusion of the conflict of laws rules. Should individual provisions of the contract with the guest, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid provision.
